    The only different benefit for a home-based business is the possibility of making a home office deduction. The key requirement for doing this is that the space used in the home is used regularly AND EXCLUSIVELY for the business.

    Most people don't qualify because of this, and for this reason the IRS tends to audit a higher percentage of returns that take this deduction.

    Go to the IRS website, and type "home office deduction" in the search box at the top right. The first link that shows up will Tax Tip 2008-53, which gives a good overview of the situation. Within that you will see links to other publications that will answer even more of your questions.

    Even if you don't qualify for the home office deduction, you still come out ahead financially. You don't have to pay rent somewhere else, and you should save money on gas.

As for the "S corporation" contact the state Attorney General 's Office or your local library and discern the differences between the two. This should answer your question and give you better information then that which we offer through this medium.

    I don't see any reason that you would need an LLC…your liability should be almost none existant.

    Having an LLC would not allow any further deductions.

    If the biggest reason you want to start one is being able to create a loss..the rules are still the same (usually a profit in 3 out of 5 years, in your case, or it is a hobby and the expenses are limited to income). Basically, all you would be doing is creating more paper work for yourself with very little if any benefit.

    I amm in NYS – started a business a few years back. It should be sole proprietorship. She can register for a tax ID # but doesn't have to. Register the business name and use her social security number. The state and feds don't mind a loss shown in April for the first year or two, but after that it must show a profit or else they will consider it a hobby and not allow for the deductions. This is direct from my accountant. Keep it simple, advertise in local publications – Pennysaver is a good place as they usually post all ads on their web site as well. Branch out into Westchester – lots of opportunity there as well.

    I'm not sure what Biz Teacher is getting at. Yes, it is legal and far more beneficial to pay her by check (cash). As long as she does not qualify as a regular employee (which you clearly state) based on IRS regs. Your friend will of course have to give her a 1099-MISC and then can deduct the amount paid out on her schedule C.

    I really don't see any cons to obtaining a FEIN, other than having to fill out the SS-4 to obtain it.

    Some of the advantages are if you ever need to obtain any financing or fill out any paperwork in the future, your SSN will not be displayed on documentation. Some of the time, if you go to get any sort of bank accounts in the business name, such as "doing business as", the bank will require you to obtain the FEIN and if you do it before hand, you have it on you. If you ever get employees, you are required to have a FEIN to file the proper employee related tax returns, i.e. Form 940 and 941.
